Personal Injury Defense – We have extensive expertise in representing insurance carriers and their insureds in personal injury and wrongful death cases arising out of all types of general liability situations in the state and federal courts of Kansas and Missouri. Our experience includes defense of premises liability claims ranging from highly technical property conditions to failure to provide adequate security. We are also experienced in defending claims for the behavior of domestic animals and violation of stock laws.

Motor Vehicle Liability Litigation – The firm has decades of experience in the representation of major insurance carriers and their insureds in defense of motor vehicle liability cases, including motorcycle liability. The firm also has experience in defending cases involving ATV and boating accidents and farm implements. The firm has developed a specific emphasis on UM, UIM, and PIP claims.

Fraud and Arson Investigation and Litigation – The firm has very specialized experience in the investigation and litigation of first party claims where the potential for an insured’s involvement in the loss exists. Frischer & Associates has conducted numerous examinations under oath throughout Kansas, Missouri and the Midwest. We have significant expertise in evaluating questionable first party claims, preparation of reservation of rights letters and if appropriate, denial letters. Frischer & Associates has worked with cause and origin experts, mechanical and electrical engineers and other experts needed to properly evaluate fire and other first party loss claims.

Insurance Coverage Analysis – Most of the firm’s insurance clients call upon us to review and analyze policies in a variety of contexts to determine the carrier’s duty to pay, defend or indemnify a given claim or insured. Frischer & Associates has instituted declaratory judgment actions and has defended numerous coverage-based actions on intentional acts, sexual abuse, coinsured clauses, materials and workmanship exclusions, concurrent causes, efficient proximate cause claims and fraud and misrepresentations in the application and in conjunction with a claim.

Property Claims – We represent insurance carriers and their insureds in claims involving a variety of fact patterns including fire losses, floods, gas and vapor explosions, wind and hail losses, vandalism and theft, commercial roofing, and structural collapse.

Large Loss Subrogation – The firm represents some of the largest insurance companies in the country in subrogation cases arising out of fire and explosion losses and products liability claims.

Business Torts – The firm represents clients in commercial litigation related to misrepresentation, contract interference, unfair competition, trade secrets, director and officer liability, employment litigation, False Claims Act, the Telephone Consumer Protection Act, and fiduciary litigation. Our experience includes class action litigation and derivative shareholder litigation.

Railroad Litigation – The firm is experienced in highly complex railroad litigation including railroad crossing accidents, railroad crossing signs/gates/safety, obstructive vegetation, and liability for the condition and presence of railroad cars. Our experience in this area includes analysis of both state and federal statutes covering railroad safety and preemption issues.

Healthcare Professional Board Complaints – The firm represents healthcare professionals against complaints by boards for negligence, practice beyond the scope of licensure, failure to adhere to acceptable standards of practice, fraud, and practice while impaired. The firm has a special emphasis on representing mental health care professionals.

Professional Malpractice – The firm represents professionals, including attorneys, insurance agents and brokers, dentists and physicians, and corporate officers and directors in professional liability, errors and omissions and malpractice claims.

Non-Compete Agreements – The firm will aggressively pursue former employees who violate non-disclosure, non-competition and non-solicitation agreements so as to protect the proprietary business practices and trade secrets that have made the client’s business successful.
